RETURNS, REFUNDS AND EXCHANGES POLICY

At Le Cheval Sportif RSA, we want you to be satisfied with your purchase. This Returns, Refunds and Exchanges Policy explains the circumstances in which products purchased through www.lechevalsportif.com may be returned, exchanged, repaired or refunded.
This Policy should be read together with our Terms and Conditions and any applicable product-specific warranty information.
Nothing in this Policy is intended to remove, restrict or waive any rights you have under applicable South African consumer protection legislation.

2. WHEN CAN A PRODUCT BE RETURNED?
A product may be returned in circumstances including:

the product is defective or unsafe;
-
the product does not meet the applicable requirements of South African consumer protection legislation;
-
the product is materially different from the product ordered;
-
the incorrect product was supplied;
-
the product was damaged before or during delivery; or
-
another legally recognised right of return applies.
Returns relating to defective, unsafe or unsuitable goods will be handled in accordance with applicable provisions of the Consumer Protection Act 68 of 2008 (CPA).
Under section 56 of the CPA, where goods fail to satisfy the applicable quality requirements, a consumer may generally return the goods within six months after delivery, without penalty and at the supplier's risk and expense. Subject to the Act, the consumer may direct the supplier to repair or replace the goods, or refund the price paid.
3. DEFECTIVE OR UNSAFE PRODUCTS
If you believe that a product is defective, unsafe or does not meet the applicable quality requirements, please contact us as soon as reasonably possible.

We may require the product to be returned so that it can be inspected and, where appropriate, tested.

Where the CPA applies and the goods qualify for a remedy under section 56, the consumer may choose the applicable remedy of repair, replacement or refund, subject to the provisions of the Act.
4. PRODUCTS DAMAGED DURING DELIVERY
Please inspect your order as soon as reasonably possible after delivery.
If your product arrives visibly damaged, or if components or accessories are missing, please contact us promptly at:

We will investigate the matter and determine the appropriate remedy in accordance with applicable law.
Where the damage occurred before the product came into your possession and a statutory remedy applies, we will not require you to bear costs that the law places on the supplier.
5. INCORRECT PRODUCT OR PRODUCT NOT AS DESCRIBED
If we have supplied an incorrect product, or the product is materially different from the product you ordered, please contact us as soon as reasonably possible.
Please provide your order number and details of the discrepancy.
Subject to verification, we will arrange an appropriate remedy, which may include:

supplying the correct product;

replacing the incorrect product; or
-
providing a refund where applicable.
Where the return is due to an error on our part, we will provide reasonable instructions regarding the return of the incorrect product.
6. EQUINE HEALTH AND WELLNESS PRODUCTS
Because we supply equine health and wellness products, certain products may be unsuitable for return once they have been opened, used, assembled or otherwise placed into use, particularly where doing so may affect hygiene, safety or the integrity of the product.
This does not affect any statutory right to return defective, unsafe or non-conforming goods.
Where a product is returned because of a valid defect or statutory consumer right, the applicable legal remedy will take precedence over any general restriction contained in this section.
7. FLEXINEB NEBULISERS
Flexineb products are subject to the applicable Flexineb warranty terms and conditions.
Customers should refer to the Flexineb section of www.lechevalsportif.com for the applicable warranty information and warranty claim procedure.
Where a Flexineb product develops a problem that may be covered by the manufacturer's warranty, customers should follow the warranty procedure published in the Flexineb section.
A warranty claim may require information such as:

proof of purchase;

product identification;
-
serial number, where applicable;
-
description of the issue; and
-
photographs or videos.
Warranty claims will be assessed in accordance with the applicable Flexineb warranty terms.
Nothing in this section limits any statutory consumer rights that apply independently of a manufacturer's warranty.
8. PRODUCTS DAMAGED THROUGH MISUSE
A return, repair, replacement or refund may not be available where a problem has resulted from misuse, abuse, unauthorised modification, incorrect installation, failure to follow manufacturer's instructions, or other conduct that has caused or contributed to the problem, except where applicable law provides otherwise.
Examples may include:

using a product for a purpose for which it was not designed;

failure to follow manufacturer's operating instructions;

unauthorised alterations or modifications;

accidental damage caused after delivery;

improper storage;
-
use of incompatible accessories or components; or

attempted repairs by an unauthorised person.
We may inspect the product to determine the cause of the reported problem.

Depending on the circumstances, we may request photographs, videos, proof of purchase or other information before authorising a return.
10. PROOF OF PURCHASE
We may request reasonable proof of purchase before processing a return, refund, repair or replacement.
Acceptable proof may include:

payment confirmation; or

other reasonable evidence of the transaction.
The absence of a particular document does not necessarily remove a consumer's statutory rights where the transaction can otherwise be established.
11. CONDITION OF RETURNED PRODUCTS
Where a return is approved, customers should return the product with all relevant:

packaging; and

other items supplied with the original product.
Where a return is based on a statutory consumer right relating to a defective or unsafe product, the applicable requirements of the CPA will apply.
12. INSPECTION OF RETURNED PRODUCTS
Returned products may be inspected to establish:

whether the product supplied was incorrect;

whether damage occurred before or after delivery;

whether the product has been misused;

whether a manufacturer's warranty applies; or
-
whether another statutory or contractual remedy applies.
An inspection does not remove or limit any statutory rights available to the consumer.
13. REFUNDS
Where a refund is due, the refund will generally be processed using the same payment method used for the original transaction, where reasonably possible.
The timing of the refund may depend on:

the return of the product;

completion of any necessary inspection;

verification of the applicable remedy; and

the processing time of the relevant payment provider or financial institution.
We will communicate with you regarding the status of the refund where reasonably necessary.
Where a statutory refund is required, the refund will be processed in accordance with applicable law.
14. EXCHANGES
Where an exchange is available and appropriate, the replacement product will generally be the same product or an equivalent product, subject to availability.
If the requested replacement product is unavailable, we will discuss the available alternatives with you.
Nothing in this section limits a consumer's statutory right to choose a remedy where the CPA provides such a right.
15. SPECIAL OFFERS AND SALE PRODUCTS
Products purchased during promotions or special offers remain subject to applicable consumer protection rights.
A sale price does not remove statutory rights relating to defective, unsafe or non-conforming goods.
Any additional terms applicable to a particular promotion will be communicated at the time of purchase.
16. WARRANTY RIGHTS ARE IN ADDITION TO STATUTORY RIGHTS
Any manufacturer's warranty or additional warranty offered with a product is separate from and in addition to statutory consumer rights where applicable.

A manufacturer's warranty does not automatically replace or remove any rights that a consumer has under applicable South African law.
17. STATUTORY CONSUMER RIGHTS
This Policy is intended to comply with applicable South African consumer protection legislation.
In particular, section 56 of the CPA provides an implied warranty of quality and, subject to the requirements of the Act, allows a consumer to return qualifying defective, unsafe or non-conforming goods within six months after delivery, without penalty and at the supplier's risk and expense.
Where a qualifying section 56 return is made, the consumer may direct the supplier to repair or replace the goods or refund the price paid, subject to the CPA.
Nothing in this Policy is intended to exclude, restrict or waive any mandatory statutory right.
